I joined the political and legal team after graduation from university in 2001. On December 19, 2011, I became a Chinese Communist gloriously. From this day on, under the guidance of the party’s brilliance, the care and cultivation of the organization, and in the united and fighting collective of the executive bureau, I have actively learned from the old party members, carried forward the party's fine tradition, and become a backbone in the executive team gradually. In 2019, I was honored as an advanced individual in the national court's work of "basically solving the difficulty of execution", and won the second-class remit of Tianjin. This honor is not only a personal commendation to me, but also a recognition to the collective of Executive Bureau of Tianjin Maritime Court. The implementation work has never been completed by one person alone. Each of my achievements is inseparable from the care of my leaders and the support of my colleagues.

Ⅰ. Remember that you are a judge who upholds fairness and justice

The court is the last line of defense to safeguard social equity, and the execution work is the last kilometer of this line of defense. As a judge, we should be fair and just and earnestly protect the legitimate rights and interests of the people.

In an execution case involving a ship, the only property of the person subject to execution, ship "Rongxiang 1", suddenly appeared in Tangshan port, Hebei Province when its whereabouts were unknown for a long time. The chance was fleeting. As a party member, I should put the interests of the parties in the first place. I asked the leaders of the court immediately for instructions at the first moment, gave up the rest on holidays and urgently boarded the ship with the bailiff. In the process of seizure, the ship owner avoided deliberately, the crew asked to pay wages in advance to get off the ship, the cargo supplier required to complete the voyage transportation, and the port side asked to pay the berthing fee. A series of problems were in the face of us. I understood that I could not cower in such a difficult and emergent situation. The enforcement personnel should stand out at crucial moment to play a key role. After 48 hours of continuous operation, the task of detaining ships in other places was successfully completed. In the subsequent process of handling the case, I successfully introduced the third-party financing outside the case and reached a tripartite reconciliation without auctioning the ship, which not only helped the bank recover all the creditor's rights, but also avoided the harm caused by auctioning the ship to fund-raising fishermen, but also enabled the enterprise to tide over the difficulties, realized the transformation from “three losses” to “three wins”, and realized the unity of legal effect and social effect. The method of avoiding rigid execution in handling cases was affirmed by the leaders of the Supreme People's court and was specially reported by the Discipline Record of Dishonesty on the legal channel of CCTV.

Ⅱ. Adhere to the people-centered concept of the rule of law

General secretary Xi Jinping pointed out that legal construction should be built for the people, rely on the people, benefit the people and protect the people and strive to make the people feel fairness and justice in every legal system, every law enforcement decision and every judicial case.

With the Spring Festival approaching in 2020, relying on the Beijing-Tianjin Railway linkage mechanism of the Municipal High Court, it was learned that Zhou, the person subject to execution in the case, would get off at 4 a.m. on January 22 and return to Tianjin at Beijing West Railway Station. At that time, the epidemic broke out and the situation was complex and severe. After receiving the instructions from the leaders of the court, on the premise of doing a good job in self-protection, we went to Beijing West Railway Station overnight and detained Zhou successfully. After escorting back to Tianjin, I learned that Zhou did have the willingness to repay, but now his business failed and his life was difficult. He worked away from home for a year just to actively repay his debts. Near the end of the year, he returned to Tianjin hoping to spend the new year with his three-year-old child.

I think it is an unalterable principle for the person subject to execution to repay the debt; However, the Chinese people's unique human feelings of returning home for the new year and father-son reunion also need our attention. On the one hand, the executors should enforce the law strictly and maintain the judicial authority. At the same time, they should also uphold good faith, solve the people's worries, relieve the people's difficulties, warm the people's hearts, and make the executee feel the social relationship, which is the proper way to resolve contradictions and disputes. Therefore, from the perspective of execution with good faith, I facilitated the reconciliation between the two parties through in-depth and meticulous work, which not only enabled the person subject to enforcement to go home for the new year, but also laid a good foundation for the successful settlement of this case.

I think that active response to reasonable appeal of the excutees is the concrete implementation and embodiment of the legal concept with people as the center in the work of execution.

Ⅲ. Adhere to concept and beliefs, courage to fight and good at fighting

In maritime execution cases, the person subject to execution in other provinces and cities accounts for a large proportion. Handling cases in different places undoubtedly increases the difficulty of implementation greatly. Comrades of the executive bureau can always carry forward the spirit of fearing no sacrifice and fighting bravely. Whether it's hot or cold, windy or rainy, whether it's a continuous business trip, or even in danger, they can rush ahead and never complain. Moreover, when encountering difficulties, we always pool our wisdom and work together. We should not only dare to fight but also be good at fighting.

In 2017, a company in Qinhuangdao defaulted on the wages of 13 crew members, but the legal representative, who lived in Huanghua, maliciously evaded the execution. During that time, these 13 families worrying about their livelihood often came to my mind. I made up my mind to get the crew's salary back. Therefore, by making full use of the judicial linkage mechanism of Beijing, Tianjin and Hebei, innovating the use of information means, and cooperating with Huanghua court, public security, detention center and other departments to exchange information and conduct spot scout, the legal representative of the company was finally detained in Huanghua city in May 2018. In fear of the judicial authority, the person subject to execution handed over the full amount of the execution fund to the court one week later. The execution and conclusion of this case has achieved a “zero breakthrough” in the inter-provincial judicial detention of Tianjin maritime court.

Now, our execution work has changed from “basically solving the difficulty of execution in three years” to a new stage of “effectively solving the difficulty of execution”. The handling of execution cases not only involves the vital interests of the parties, but also sometimes affects the whole situation. Just handling cases and rigid execution cannot properly solve all contradictions properly. We need to convince people with reason and move people with emotion. But most importantly, we need a team with excellent quality. Every executive judge should have a firm ideal and belief, a steel-like responsibility, a steel-like excellent skill and a steel-like style of discipline.

On the road of building the socialist rule of law with Chinese characteristics, we need the efforts of generation after generation. I am willing to be a paving stone on this road, contribute my part to the realization of the comprehensive rule of law, and live up to the original intention and mission of Communist Party members in the new era.
