Exploring a New Model of "Fengqiao Experience at Sea" through Diversified Dispute Resolution and Linkage

Mr. Li purchased a sea yacht from Mr. Qi through an online platform, but due to the yacht's power exceeding the prescribed upper limit and not meeting the policy requirements of the yacht's operating location, he was unable to complete the registration procedures, resulting in the yacht being stored in Beijing and unable to be delivered on time by the manufacturer.

After multiple unsuccessful negotiations, Mr. Li filed a lawsuit with the Beidaihe Primary People's Court, Qinhuangdao. Judge of the Beidaihe Primary People's Court, Qinhuangdao found that the case was a dispute over a ship sales contract and should be under the exclusive jurisdiction of the maritime court. Therefore, it contacted Tianjin Maritime Court to prepare to initiate the case transfer procedure.

After learning of the case, the judge of the Qinhuangdao Tribunal of Tianjin Maritime Court found that the residences of both parties in the case were located in Tianjin and Qinhuangdao respectively, and the involved vessel was stored in Beijing. There would be certain inconveniences for the parties to participate in the lawsuit and the court to investigate the facts of the case. In order to effectively reduce the litigation burden caused by the transfer procedure, Tianjin Maritime Court, after consultation with Beidaihe Primary People's Court, Qinhuangdao, decided to launch the "Judicial Cooperation Framework Agreement between Tianjin Maritime Cour and Qinhuangdao Intermediate People's Court of Hebei Province". The judges of the two courts would jointly mediate this case and share diverse dispute resolution resources. After obtaining the consent of both parties, Tianjin Maritime Court invited a specially invited mediator hired by the Court at the Beidaihe Maritime Department of Qinhuangdao Maritime Bureau to participate in the mediation work, further improving the effectiveness of dispute resolution.

On May 6th, 2024, a joint mediation with "judges from two cities and the specially invited mediator" officially kicked off in the roundtable mediation room of the Beidaihe Primary People's Court, Qinhuangdao. After more than two hours of mediation, both the plaintiff and defendant made a certain prediction of their respective claims and unanimously agree that, based on their respective evidence improvement, the judges of both courts will continue to organize further mediation. On May 30th, judges from both courts organized joint mediation between the parties in the Qinhuangdao Tribunal of Tianjin Maritime Court, and ultimately reached a settlement agreement.
